Detroit Mayor Kwame Kilpatrick in More Hot Water - Spends night in Jail

After spending a night in jail, Detroit Mayor Kwame Kilpatrick faces new felony charges even as a judge ruled Friday that he could go free if he wears a tracking device and doesn't leave town.

Kilpatrick's lawyers are negotiating his surrender on charges of assaulting or obstructing two police officers who attempted to serve a subpoena, Michigan Attorney General Mike Cox said.

If convicted, Kilpatrick could face up to two years in prison, Cox told reporters. He also would be unable to serve as mayor.

"In almost 20 years as a prosecutor and now as attorney general, I cannot recall one case where someone has assaulted a police officer who was attempting to serve a subpoena," Cox said.

Kilpatrick's latest legal skirmish began July 24 when two officers attempted to serve a subpoena on a friend who was a potential witness in Kilpatrick's pending perjury case, Cox said. He alleged that an "irate and angry" Kilpatrick grabbed one of the officers and shoved him into the other, screaming at both of them and using abusive language.

One of the mayor's lawyers, James Thomas, told reporters he would fight the new charges with "law and common sense."

Earlier, a Wayne County Circuit Court judge ruled Kilpatrick could be released from jail if he posted a $50,000 cash bond, wore a GPS device and didn't travel outside the Detroit area.

Kilpatrick was jailed Thursday after a judge found he had violated terms of his bond by taking an unauthorized trip to Canada last month. Watch how Detroit's mayor wound up behind bars »

Kilpatrick, who is facing felony charges of perjury, obstruction of justice and misconduct of office, had been free on $75,000 bond.

Under the terms of his bond, Kilpatrick was required to give the court 48 hours' notice for business travel, District Court Judge Ronald Giles noted Thursday.

The mayor has been snarled in a public scandal since January, when the Detroit Free Press reported he exchanged romantic text messages with his former chief of staff, Christine Beatty, indicating the two were involved in an affair.

He and Beatty, testifying last fall in a whistle-blower trial, had denied they had been having an affair.

The lawsuit and another unrelated case was settled for about $8 million, the officer's attorneys said. Critics have said Kilpatrick settled the case in part to keep the affair with Beatty secret.

Earlier Thursday, Kilpatrick and Beatty waived their preliminary examination and agreed the case could be forwarded to Wayne County Circuit Court's Criminal Division.

Yest another Democrat who couldn't keep it in his pants

They met in a bar in 2004. He was the top aide to the top Democrat in the House. She was a 21-year-old graduate student with dreams of becoming a lawyer. They had a few drinks. They went to his car for a quick tryst.

A year later, according to a Pennsylvania grand jury, Angela Bertugli had a state job, which was arranged by Michael Manzo, 39, the man with whom she allegedly was having a fling and who was then chief of staff to House Majority Leader Bill DeWeese (D., Greene).

"Bertugli concluded, with certainty, that Manzo hired her because she was having sex with him," a grand jury presentment released yesterday said.

The job-for-sex allegation was a surprising revelation in the 74-page presentment that accused Manzo and 11 others of using taxpayer dollars to support political campaigns.

Bertugli was not charged, and she has apparently cooperated with authorities.

According to court documents, she told officials that she never was interviewed for the state job, nor did she fill out an application.

On the surface, she was supposed to have been hired to staff "the Pittsburgh Field Office" for the House's newly formed Allegheny County delegation. She was told by Manzo to report to work in September 2005, at a dingy office above a cigar shop in Pittsburgh.

She worked three days a week and was paid $21,000 annually in what prosecutors called a "ghost" job.

For 70 percent of the time, Bertugli had nothing to do, prosecutors said, so she studied. When she did work, it often was on campaign tasks, not government duties.

She did such a good job at doing nothing, prosecutors allege, that she got a raise in 2006 to nearly $30,000. That year, there were $7,100 in bonuses on top of that.

"The percentages of school work/idleness and campaign work remained constant until she left the Pittsburgh office in July 2007," court documents filed yesterday read. "Bertugli's sexual encounters with Manzo when he was in Pittsburgh continued as well."

With Manzo's help, Bertugli got into law school in Harrisburg - and her job was transferred to the Capitol.

Manzo's attorney, James Eisenhower, yesterday disputed that Bertugli's employment amounted to a "ghost job." He said he believed his client would be vindicated. "It was a real job, and she was qualified for it," he said.

Manzo and his wife, Rachel, were married in 2006. Rachel Manzo, also an aide to House Democrats, also was charged in the indictment.

Michael Manzo was among seven top Democratic aides forced from their jobs by DeWeese in November. About the same time, the Bertugli-Manzo relationship ended.

26-year-old Kelsey Peterson accused of having sex with a 13-year-old student

A former teacher accused of having sex with a 13-year-old student and fleeing with him to Mexico is expected to plead guilty to reduced charges, her attorney said Tuesday.

James Martin Davis, the attorney for 26-year-old Kelsey Peterson, said his client will plead guilty Wednesday to federal charges of transporting a minor across state lines for the purpose of sex.

It's similar to the original charge of crossing a border to have sex with a minor but doesn't carry a minimum 10-year-sentence, Davis said.

A message left for the U.S. Attorney's office in Nebraska on Tuesday wasn't immediately returned.

Peterson and the boy left Lexington in October. They were found a week later in Mexicali, Mexico.

The boy, who is now 14, has told The Associated Press that he didn't consider Peterson his girlfriend but that they did have sex.

Davis has maintained that the law under which Peterson was being charged was more severe and was intended to combat forced prostitution. Other women accused of sex with minors didn't face nearly as harsh of sentences, he said.

"She's always said like I did, she'd plead to what she did do, but she wasn't going to plead to what she didn't do," Davis said Tuesday.

Davis said he expects his client will spend six to seven years in prison. She could be sentenced to up to 30 years, Davis said.

He said he hopes state charges, which include kidnapping and first-degree sexual assault, will be dropped. An after-hours call to the Dawson County attorney's office on Tuesday wasn't answered.

The Associated Press previously named the boy as police were searching for him but stopped using his name after authorities charged Peterson with a sex crime.

He was an illegal immigrant in the United States when he left with Peterson. He is back in Nebraska temporarily after being granted humanitarian parole by the Department of Homeland Security.

Barbara Walters admits affair with U.S. Senator Edward Brooke

After three decades of keeping mum, Barbara Walters is disclosing a past affair with married U.S. Senator Edward Brooke, whom she remembers as "exciting" and "brilliant."

Appearing on "The Oprah Winfrey Show" scheduled to air Tuesday, Walters shares details of her relationship with Brooke that lasted several years in the 1970s, according to a transcript of the show provided to The Associated Press.

A moderate Republican from Massachusetts who took office in 1967, Brooke was the first African-American to be popularly elected to the Senate. Both he and Walters knew that public knowledge of their affair could have ruined his career as well as hers, Walters says.

At the time, the twice-divorced Walters was a rising star in TV news and co-host of NBC's "Today" show, but would soon jump to ABC News, where she has enjoyed unrivaled success. Her affair with Brooke, which never before came to light, had ended before he lost his bid for a third term in 1978.

Brooke later divorced, and has since remarried. Calls to a listing for Brooke in Miami by The Associated Press were not immediately returned Thursday.

Walters is the guest of Oprah Winfrey to discuss her new memoir, "Audition," which covers her long career in television, as well as her off-camera life. On "Oprah," Walters recounts a phone call from a friend who urged her to stop seeing Brooke.

"He said, 'This is going to come out. This is going to ruin your career,'" then reminded her that Brooke was up for re-election a year later. "'This is going to ruin him. You've got to break this off.'"

Winfrey asks Walters if she was in love.

"I was certainly — I don't know — I was certainly infatuated."

"I was certainly involved," Walters says. "He was exciting. He was brilliant. It was exciting times in Washington."

Also during the program, Walters chokes up while describing the struggles of her older sister Jackie, who was mentally retarded. Walters confesses that, as a child, she sometimes felt embarrassed by Jackie.

"She stuttered terribly. People made fun of her. People made fun of me," Walters says. "I didn't bring friends home. I felt terribly guilty because she was very loving and I didn't always feel that way."

Jackie Walters died in 1985 of ovarian cancer.

"When I think of her, because she was beautiful and loving and all of that, it makes me cry."

Edward Brooke is Republican from Massachusetts who took office in 1967 to become the first African-American to be popularly elected to the Senate. Barbara Walters was co-hosting NBC's "Today" show at the time of their affair and Brooke was in the Senate, but the relationship ended before Edward Brooke lost his third bid for the job. “I believe that we did our due diligence, and as a result of that clearly believe that it’s him,” said Steven Hirsch, Vivid’s co-chairman told the Times. “If they said that it wasn’t him, I would never have put it out.”

Some who knew Hendrix, who died of a drug overdose in 1970 at the age of 27, disagree. Kathy Etchingham, one of his girlfriends from the 1960s, says the man in the film couldn’t be Hendrix.

“He would never have allowed anyone to see that,” she told the Times. “In private he was very shy and would cover up.”

Morgan also says you can tell it is Marilyn because, "she has the famous mole."

So will Paris Hilton be knocked off her thrown as the sex tape goddess? Nope, the "businessman" who bought the tape says he is keeping it to himself, "The gentleman who bought it said out of respect for Marilyn he's not going to make a joke of it and put it on the Internet and try to exploit her," claims Morgan.

So hopefully someone made a third copy of that film, because if Lindsay Lohan just posing as Monroe was as huge as it was imagine how big this would be if it hit the Internet!

Detroit Mayor Charged with purgury over sex scandel

DETROIT - Mayor Kwame Kilpatrick, a one-time rising star and Detroit's youngest elected leader, was charged Monday with perjury and other counts after sexually explicit text messages contradicted his sworn denials of an affair with a top aide. Wayne County Prosecutor Kym Worthy also charged the popular yet polarizing 37-year-old mayor with obstruction of justice and misconduct in office. Kilpatrick could face up to 15 years in prison and be expelled from office if convicted.

His resignation was triggered by a federal affidavit that linked him to a high-class call girl service and according to which he met "Kristen" aka Ashley Dupree and other prostitutes at least times.

The description left out that she was an aspiring singer whose MySpace page featured her song "What We Want" with hip-hop lyrics like, "I know what you want, you got what I want. I know what you need. Can you handle me?"

Her online profile also hints at hard times. "What destroys me strengthens me" is the motto next to her photo. She claims she left a "broken home" after enduring "abuse."

In a bluesy mood, she wrote, "I have been alone. I have abused drugs. I have been broke and homeless. But, I survived, on my own. I am here, in NY because of my music."

At another point she writes defiantly, "But I made it ... I'm still here and I love who I am."

In an Aug. 30 blog posting on MySpace, she wrote: "The past few months have been a roller coaster with so-called friends, lovers, and family ... but it's something you have to deal with and confront in order to move on ..."

WASHINGTON (CNN) -- New York Governor Eliot Spitzer, a key backer of Hillary Clinton and a rising Democrat star who rose to prominence rooting out corruption, was facing calls to resign Tuesday over allegations he paid thousands of dollars to a prostitute.

Spitzer immediately apologized to his family and the people of New York but did not elaborate on the scandal.

At a hastily convened news conference in Albany, the state capital, he confessed Monday to an undisclosed personal indiscretion, saying he had acted "in a way that violates my obligations to my family."

"I have disappointed and failed to live up to the standard I expected of myself," the 48-year-old father of three teenage girls said. "I must now dedicate some time to regain the trust of my family."

Once seen as a rising star within the Democratic party, Spitzer took office in January 2007 with a landslide victory after serving eight years as the state's attorney general. But the scandal raises questions about whether he will make it through a second year.

"I think there's no question if he is involved -- and I'm not saying he is, because we don't know all the facts -- I would say he'd have to resign," said James Tedisco, the Republican minority leader in the state Assembly.

Tedisco said Spitzer's push to reform government "loses all validity if he was involved in something illegal like that."

The Republican Governors Association called on Spitzer to resign to "allow the people of New York to pursue honest leadership."

"The American people are tired of corrupt and hypocritical politicians. The governor of New York is just another in the long list of politicians that have failed their constituents," said Nick Ayers, executive director of the Governors Association.

U.S. presidential candidate Hillary Clinton sidestepped questions about the sex scandal threatening her home state governor and political ally.

"I don't have any comment on that," she said when asked about the allegations. "Obviously, I am sending my best wishes and thoughts to the governor and to his family," Clinton said.

The allegations, revealed Monday in The New York Times, were outlined in federal court papers detailing a meeting in a Washington hotel room last month between a prostitute and a client who a source told CNN was Spitzer.

The affidavit does not mention Spitzer by name, but a source with knowledge of the case said the subject identified as Client-9 is the governor. He has not been charged.

His alleged involvement with the ring was caught on a federal wiretap, the source said.

The prostitute, identified only as "Kristen" worked for the Emperors Club, which charged between $1,000 and $5,500 an hour and operated in New York; Los Angeles, California; Miami, Florida; London, England; and Paris, France, according to court papers.

According to the affidavit, defendant Temeka Rachelle Lewis -- who is accused of working as a booking agent for the club -- wrote a text message Monday, February 11, asking the operation's day-to-day organizer to "pls let me know if (Client-9's) 'package' arrives 2mrw. Appt wd be on Wed." Prosecutors say the message was a reference to a deposit.

On Tuesday, according to the affidavit, Lewis sent a message to Kristen, saying Client-9's deposit had not arrived but she should be able to "do the trip" if it arrived the next day.

In a later conversation, Lewis and Kristen discussed when the prostitute could take a train from New York's Penn Station to Washington's Union Station, the affidavit says. Client-9 would be "paying for everything -- train tickets, cab fare from the hotel and back, mini bar or room service, travel time, and hotel."

The affidavit says that, about 5 p.m. Tuesday, February 12, Lewis spoke with Client-9 on the telephone and told him that his "package arrived today." The client asked Lewis whom he would be meeting and, when told it was Kristen, said, "Great, OK, wonderful."

The two discussed how the woman would get a key to his room for a Wednesday rendezvous and how they could arrange credit for future services.

"Client-9 asked Lewis to remind him what Kristen looked like and Lewis said that she was an American, petite, very pretty brunette, 5 feet 5 inches and 105 pounds," the affidavit reads.

In a call to Lewis, Client-9 was told the balance would be $2,712.41, but Lewis suggested he give Kristen $1,500 or $2,000 more so that he would have a credit.

According to the affidavit, Kristen called Lewis about 9:32 p.m. Wednesday, February 13, and told her she was in Client-9's room -- No. 871 -- at the Washington hotel.

Four minutes later, Client-9 was in the hotel, Lewis told Kristen in another call.

No more calls were logged until 12:02 a.m. Thursday -- Valentine's Day -- nearly 2½ hours later. At that time, Kristen told Lewis Client-9 had left and she had collected $4,300.

Lewis told the prostitute she'd been told that Client-9 "would ask you to do things that, like, you might not think are safe -- you know -- I mean that ... very basic things," the affidavit says.

Spitzer, who built his career on rooting out public corruption as New York attorney general, became a national figure with a series of high-profile Wall Street investigations. He is also known for prosecuting prostitution rings. Read Todd Benjamin's blog

People who know Spitzer, 48, were surprised by the allegations. "To say this is a shock is an understatement," said CNN senior legal analyst Jeffrey Toobin, who went to law school with Spitzer.
